Information on Settlement Payments
On September 18, 2006, the Honorable Peter J. Messitte, U.S. District Judge, approved settlements with the principal defendants, Andris Pukke, DebtWorks, Inc., Infinity Resources Group, Inc., Erics Pukke, Debticated Credit Counseling, Inc., and Pamela Pukke. Since that time, the Court’s Receiver has been collecting monies to fund the settlement from those defendants.
If you were a client of AmeriDebt, your share of the settlement fund was mailed to you by the Federal Trade Commission on September 8, 2008. If you were a client of another agency, your share was mailed to you on October 28, 2008.
The Polacsek and FTC cases challenged only your “voluntary contributions” or fees paid to the credit counseling agencies. The cases did not attempt to challenge or recover the majority of your payments which were intended for your creditors.
Your share of the proceeds is a pro rata portion of the available settlement fund based on the total amount of the fees or contributions you paid and the number of class members.
Unfortunately, the Receiver was unable to collect sufficient funds to pay you back all of the “voluntary contributions” or fees you paid. The Receiver did not recover enough money to reimburse all of the fees or contributions you paid.
